{"id":90366,"date":"2019-10-31T15:06:54","date_gmt":"2019-10-31T14:06:54","guid":{"rendered":"https:\/\/www.dev.asgi.it\/sciabaca-oruka\/asgis-case-against-italian-government-for-supporting-the-libyan-coastguard-through-misuse-of-africa-fund-money-goes-on-appeal\/"},"modified":"2019-10-31T15:06:54","modified_gmt":"2019-10-31T14:06:54","slug":"asgis-case-against-italian-government-for-supporting-the-libyan-coastguard-through-misuse-of-africa-fund-money-goes-on-appeal","status":"publish","type":"sciabaca-oruka","link":"https:\/\/www.dev.asgi.it\/en\/sciabaca-oruka\/asgis-case-against-italian-government-for-supporting-the-libyan-coastguard-through-misuse-of-africa-fund-money-goes-on-appeal\/","title":{"rendered":"ASGI\u2019s case against italian government for supporting the Libyan Coastguard through misuse of &#8220;Africa Fund&#8221; money goes on appeal"},"content":{"rendered":"\n<h4 class=\"wp-block-heading\">On 27 June 2019, the Italian Supreme Administrative Court held the first hearing in the case initiated by the Association for Legal Studies on Migration (ASGI) against the Italian Government for allegedly misusing cooperation and development money to provide operational support to the Libyan Coast Guard (LCG), in a bid to stem the flow of migrants trying to reach Italian shores.<\/h4>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-_4f6a1c-83\"><div class=\"kt-block-spacer kt-block-spacer-halign-left\" style=\"height:20px\"><hr class=\"kt-divider\" style=\"border-top-color:rgba(238, 238, 238, 1);border-top-width:1px;width:80%;border-top-style:solid\"\/><\/div><\/div>\n\n\n\n<p class=\"has-text-color has-vivid-red-color\"><a href=\"https:\/\/sciabacaoruka.asgi.it\/wp-content\/uploads\/2019\/10\/Africa-Fund-case-FAQ.pdf\">Infographic<\/a><\/p>\n\n\n\n<p class=\"has-text-color has-vivid-red-color\"><a href=\"https:\/\/sciabacaoruka.asgi.it\/wp-content\/uploads\/2019\/10\/Presentation-Africa-Fund.pdf\">FAQ<\/a><\/p>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-_68ff44-30\"><div class=\"kt-block-spacer kt-block-spacer-halign-left\" style=\"height:20px\"><hr class=\"kt-divider\" style=\"border-top-color:rgba(238, 238, 238, 1);border-top-width:1px;width:80%;border-top-style:solid\"\/><\/div><\/div>\n\n\n\n<p>ASGI claims that 2,5 out of the 200 million Euros allocated to the 2016 \u201cAfrica Fund\u201d, whose purpose was to enhance dialogue and cooperation with key African partners, were used to improve the LCG\u2019s capacity to carry out sea border control activities instead, including through restoration of LCG\u2019s patrol vessels and training of its staff.<\/p>\n\n\n\n<p>The\nItalian Government admits that the 2,5 million were used to restore\nfour LCG patrol vessels, purchasing spare parts, and training LCG\nstaff, but claims that this is in line with the \u201cAfrica Fund\u201d\npurpose and with and Italy\u2019s obligations under international law.<\/p>\n\n\n\n<p>\nIn addition to being a misuse of funds, in ASGI\u2019s\nview, enhancing the LCG\u2019s operational capability to pull back\nmigrants into Libya, where they are systematically detained and\ntortured in detention centers ran by the Libyan Ministry of Interior,\nalso contributes directly to gross human rights violations, in\nviolation of the Italian Constitution and Italy\u2019s obligations under\nthe ECHR and international customary law. Since the patrol vessels\ncan also be employed in military operations, Italy\u2019s actions also\nviolate a 2016 EU Council regulation banning the provision of\nequipment that can be used to fuel the Libyan conflict, ASGI claims.<\/p>\n\n\n\n<p>On\n30 October 2017 ASGI submitted a lawsuit against the Italian\nGovernment, moving the Regional Administrative Court in Rome to\ndeclare the ministerial decree authorizing the 2,5 million\ndisbursement as null and void. Amnesty International, ECRE and the\nInternational Commission of Jurists intervened in the proceedings,\nendorsing ASGI\u2019s claims that the Italian Government\u2019s actions\nviolate international law.<\/p>\n\n\n\n<p>On\n7 January 2019, the Court handed down its judgment rejecting ASGI\u2019s\nclaims. On 10 May, ASGI lodged an appeal with the Italian Supreme\nAdministrative Court in a bit to overturn the first instance\njudgment. The main trial, which started today, is expected to last a\nfew months.
