{"id":90393,"date":"2020-05-22T09:00:21","date_gmt":"2020-05-22T07:00:21","guid":{"rendered":"https:\/\/www.dev.asgi.it\/sciabaca-oruka\/the-italian-supreme-administrative-court-orders-the-ministry-of-foreign-affairs-to-release-ioms-financial-reports-for-projects-financed-by-the-italian-government-in-libya\/"},"modified":"2020-05-22T09:00:21","modified_gmt":"2020-05-22T07:00:21","slug":"the-italian-supreme-administrative-court-orders-the-ministry-of-foreign-affairs-to-release-ioms-financial-reports-for-projects-financed-by-the-italian-government-in-libya","status":"publish","type":"sciabaca-oruka","link":"https:\/\/www.dev.asgi.it\/en\/sciabaca-oruka\/the-italian-supreme-administrative-court-orders-the-ministry-of-foreign-affairs-to-release-ioms-financial-reports-for-projects-financed-by-the-italian-government-in-libya\/","title":{"rendered":"The Italian Supreme Administrative Court orders the Ministry of Foreign Affairs to release IOM\u2019s financial reports for projects financed by the Italian Government in Libya"},"content":{"rendered":"\n<h5 class=\"wp-block-heading\">ASGI, in the framework of the projects <em>Sciabaca and Oruka<\/em>,  has presented requests to access the financial reports of projects  implemented by IOM and other international organizations in Libya. <\/h5>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-_cedc61-ac\"><div class=\"kt-block-spacer kt-block-spacer-halign-left\" style=\"height:20px\"><hr class=\"kt-divider\" style=\"border-top-color:rgba(238, 238, 238, 1);border-top-width:1px;width:80%;border-top-style:solid\"\/><\/div><\/div>\n\n\n\n<p class=\"has-text-color has-vivid-red-color\"><a href=\"https:\/\/sciabacaoruka.asgi.it\/wp-content\/uploads\/2020\/05\/Sentenza-3012.2020.pdf\"> Judgment  no. 3012\/2020 <\/a><\/p>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-_cc50ab-34\"><div class=\"kt-block-spacer kt-block-spacer-halign-left\" style=\"height:20px\"><hr class=\"kt-divider\" style=\"border-top-color:rgba(238, 238, 238, 1);border-top-width:1px;width:80%;border-top-style:solid\"\/><\/div><\/div>\n\n\n\n<p>ASGI, in the framework of the projects <em>Oruka and Sciabaca: beyond the border<\/em>, with the help of a lawyers\u2019 team composed of Salvatore Fachile, Gennaro Santoro, Giulia Crescini and Elisabetta Buranello, has presented a <a href=\"https:\/\/sciabacaoruka.asgi.it\/en\/italy-funded-projects-implemented-in-libya-by-international-organizations\/\">series of requests<\/a> to access the financial reports of projects funded by the Italian Ministry of Foreign Affairs and implemented by IOM and other international organizations in Libya.<\/p>\n\n\n\n<p>With\nits judgment of 13 May 2020, no. 3012\/2020, the Court reaffirmed that\nthe fundamental principles regarding transparency and access to\ninformation provided for by Legislative Decree no. 33\/2013 are also\napplicable to the use of Italian funds given to IOM or other\ninternational organizations to carry out humanitarian programs.<\/p>\n\n\n\n<p>The\nCourt confirmed that the Freedom of Information Act provides for the\npossibility for each citizen, even without a specific reason, to\nrequest the public administration to account for the use of public\nresources.<\/p>\n\n\n\n<p>Furthermore,\nit stated for the first time that this principle applies also the\nactions of United Nations agencies, which are subject to the same\nduties of transparency towards citizens, including for reports sent\nto the Italian government as the project\u2019s donor.<\/p>\n\n\n\n<p>More\nprecisely the Court stated that all documents that are not covered by\nState secret are accessible and cannot be withheld unless the public\nadministration gives precise reasons, detailing the public interests\ncompromised by their disclosure. In case of controversy, it is up to\nthe judge to assess the merits of the administration\u2019s refusal, to\ncheck whether or not it is reasonable.<\/p>\n\n\n\n<p>In\nthe case at stake, said the Court, \u201ca public interest against the\ndocument\u2019s disclosure was not even alleged\u201d, adding that \u201cto\nthe contrary, there is an objective public interest in preventing the\nmismanagement of these funds, through a better understanding of what\nfinancial resources were allocated and for what purpose\u201d.<\/p>\n\n\n\n<p>The\nCourt therefore rejected the Ministry of Foreign Affairs\u2019 and the\nIOM\u2019s arguments to deny access to the financial reports on\nactivities carried out by IOM in Libya in execution of a project\nfinanced by the Italian Government.<\/p>\n\n\n\n<p>The\nItalian Government could have adequately protected privacy and safety\nof third parties involved simply by redacting sensitive names of\nindividuals, companies and places, and providing the reasons thereof.<\/p>\n\n\n\n<p>The\njudgement is of strategic importance, since it enables Italian civil\nsociety to learn about expenditures in humanitarian projects that\nUnited Nations agencies, including the IOM, carry out in Libya and\nelsewhere with Italian funding. This will provide access to more\ndetailed data and information, making it possible to understand the\nexact role played by international organizations in Libya and other\ncrisis contexts. It may also assist court cases where NGOs have\nrequested administrative courts to rule on whether IOM\u2019s assisted\nvoluntary return programmes from Libya, implemented with Italian\nfunds, are
