Degrading treatments in detention centres in Libya: is it possible to claim compensation from the Italian State?"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/sciabacaoruka.asgi.it\/wp-content\/uploads\/2023\/01\/SITO-3-1024x424.png\" alt=\"\" class=\"wp-image-36776\"\/><\/figure>\n\n\n\n<p class=\"has-pale-cyan-blue-background-color has-background\"><strong>What it is about<\/strong><\/p>\n\n\n\n<p>With the Italy-Libya Memorandum of February 2017 the Italian State made specific international commitments to the government in Tripoli on the management of migration flows. Among other things, the Italian government committed to \u201cadapt and finance\u201d Libyan detention centres for irregular migrants, as well as to train the Libyan personnel working there.<\/p>\n\n\n\n<p>Thus, in 2017 the Italian Agency for Development Cooperation (AICS) allocated 6 million euro for interventions inside the Libyan detention centres for migrants, dividing the amount into three calls addressed to Italian NGOs, to be implemented through Libyan implementing partners.<\/p>\n\n\n\n<p>It was already public knowledge at the time that Libyan centres are places where managers often perpetrate severe abuses against detainees, widely documented by a plurality of international observers.<\/p>\n\n\n\n<p>In May 2020, the Court of Messina convicted three guards of the Al Nasr center in Zawiya, site of one of the AICS projects, worth one million euro, to long prison terms for severe abuses and violence committed inside the centre, run by the al Nasr clan to which the well-known trafficker Abdurahman al Milad, known as \u201cBija\u201d, belongs.<\/p>\n\n\n\n<p>In the calls under review, AICS also openly acknowledges that the government in Tripoli seems to have a merely nominal control over many of the centres, which are de facto run by local militias.&nbsp;<\/p>\n\n\n\n<p>In spite of this, AICS did not set up a check on the use of funds until a few months ago. ASGI also published a <a href=\"https:\/\/sciabacaoruka.asgi.it\/wp-content\/uploads\/2020\/07\/Profili-critici-delle-attivita%CC%80-delle-ONG-italiane-nei-centri-di-detenzione-in-Libia-con-fondi-AICS-1.pdf\">report<\/a> on the critical profiles of Italian NGOs\u2019 activities operated within detention centres in Libya with AICS funds.<\/p>\n\n\n\n<p class=\"has-pale-cyan-blue-background-color has-background\"><strong>What else can be done<\/strong><\/p>\n\n\n\n<p>Apart from challenging the legitimacy of the use of funds in detention centres in Libya, what we intend to do is try to claim compensation for the conditions suffered by third country nationals in detention centres in Libya.<\/p>\n\n\n\n<p>In particular, if third country nationals have been in the following reception centres, it is theoretically possible to promote litigation against the Italian State because AICS funded projects have been operating there:&nbsp;<\/p>\n\n\n\n<p>Tarek al Sika&nbsp;<\/p>\n\n\n\n<p>Tarek al Matar&nbsp;<\/p>\n\n\n\n<p>Tajoura&nbsp;<\/p>\n\n\n\n<p>Qasr bin Gashir&nbsp;<\/p>\n\n\n\n<p>Al Nasr (Zawiya)&nbsp;<\/p>\n\n\n\n<p>Khoms&nbsp;<\/p>\n\n\n\n<p>Al-Sabaa&nbsp;<\/p>\n\n\n\n<p>Dar el Jabal (Zintan)&nbsp;<\/p>\n\n\n\n<p>Sabratha&nbsp;<\/p>\n\n\n\n<p>Zwara\/Zuwara&nbsp;<\/p>\n\n\n\n<p>Legal advisors and lawyers can therefore collect information, report to this project or promote litigation for those who have suffered degrading treatments in these centres.<\/p>\n\n\n\n<p>Members of Parliament should ask the government and the Ministry of Foreign Affairs to report on how the funds are spent in detention centres and in Libya, on the monitoring mechanisms and the guarantees required.<\/p>\n\n\n\n<p>For more information: <\/p>\n\n\n","protected":false},"excerpt":{"rendered":"<p>What it is about With the Italy-Libya Memorandum of February 2017 the Italian State made specific international commitments to the government in Tripoli on the management of migration flows.
